You agree to: Use school and gallery codes only for their intended purpose; Keep passwords and access codes confidential; Access only portraits and information you are authorized to view; Not publish a private access code or gallery link; Not attempt to access another student’s portraits or information; Not bypass or interfere with our security measures; and Contact us if you believe that an account, access code, gallery, or student record has been accessed improperly. Possession of an access code does not transfer ownership or copyright in a photograph. It also does not authorize you to copy, screenshot, download, reproduce, or distribute an unpaid proof. We may suspend access to a gallery, account, school code, or ordering feature if we reasonably suspect misuse, fraud, unauthorized access, or a security concern. 6. Orders You are responsible for reviewing your order before submitting it. Please verify: The student’s first and last name; Student identification number; School and homeroom; Selected package; Selected image or pose, when applicable; Product sizes and quantities; Spelling and personalization; Billing and delivery information; Email address and telephone number; and Total purchase price. An order is not accepted until payment has been authorized and you receive an order confirmation. An automated confirmation only means that we received your submission. It does not prevent us from correcting a pricing error, verifying an order, addressing suspected fraud, or determining that a product is unavailable. We may decline or cancel an order because of: Failed payment; Incorrect pricing; Product unavailability; Missed ordering or production deadlines; Suspected fraud or unauthorized activity; Technical errors; Inaccurate student information; or Other reasonable business or security concerns. If Logan’s Photography cancels an order after payment has been collected, we will issue an appropriate refund for the canceled portion. 7. Payments By submitting an order, you authorize the charge displayed during checkout, including applicable: Product prices; Sales taxes; Shipping charges; Processing charges; Session fees; Deposits; and Other charges disclosed before purchase. Payments may be handled by third-party payment processors. Your payment provider may have separate terms and privacy practices. If our payment processor handles complete credit or debit card numbers, Logan’s Photography may not directly receive or store the complete card number. You are responsible for ensuring that you are authorized to use the selected payment method. 8. Prices, Promotions, and Ordering Deadlines Prices and available products may differ by school, photography program, ordering period, and delivery method. Preorder prices, promotional discounts, package pricing, free school delivery, and other offers may only be available during the stated promotional period. Orders submitted after a deadline may: Have different prices; Include fewer product options; Require additional processing; Incur shipping or handling charges; Take longer to produce; or Be delivered directly to the customer instead of the school. Promotions: Apply only during the stated period; May be limited to certain schools or products; May not be combined unless expressly permitted; Have no cash value; and May be modified or discontinued where legally permitted. We reserve the right to correct pricing, product-description, typographical, and technical errors. If an error affects an order you have already submitted, we may contact you to obtain approval, offer an alternative, or cancel and refund the affected portion. 9. Portrait and Product Variations Photography is both an artistic and technical service. Printed products may not look exactly the same as images displayed on a telephone, tablet, or computer. You understand that: Device screens may display colors differently; Printed color and brightness may vary slightly; Cropping may differ according to the selected print size; Online previews may be compressed or displayed at reduced resolution; Product sizes may be approximate; Backgrounds and poses may vary by program; Minor differences may occur in color, texture, placement, or finish; and Eyeglass glare, hairstyles, clothing, facial expressions, weather, student cooperation, and other circumstances can affect the final portrait. Logan’s Photography may make reasonable technical adjustments, including: Cropping; Exposure correction; Color correction; Basic image enhancement; and Other normal production adjustments. Specialized retouching or editing is not included unless it is specifically purchased or agreed to in writing. A customer’s personal preference regarding an expression, hairstyle, clothing choice, or pose does not necessarily mean that the photograph or product is defective. 10. Processing and Delivery Processing and delivery dates are estimates unless Logan’s Photography expressly provides a written guarantee. Orders may be: Delivered to a participating school; Shipped to the address provided by the customer; Picked up from our studio; Provided through a secure digital download; or Delivered through another method disclosed during checkout. School delivery depends on school schedules, campus access, holidays, closures, and the school’s distribution process. After an order has been delivered to a school, Logan’s Photography may not control how quickly the school distributes it. After an order has been transferred to a shipping carrier, delivery may be affected by carrier delays or circumstances outside our reasonable control. You are responsible for providing accurate delivery information. Additional charges may apply if an order must be reprinted or reshipped because: An incorrect address was provided; The customer failed to retrieve the package; The package was returned as undeliverable; or The customer failed to report an address change. Please report a missing, damaged, or incorrect order promptly after the expected delivery date or receipt of the product. 11. Cancellations and Order Changes Photography products are customized and may be produced specifically for an individual student. Therefore, an order may not be changed or canceled after it enters production. Contact Logan’s Photography as quickly as possible if you need to request a correction or cancellation. We will make reasonable efforts to assist, but we cannot guarantee that a change can be made after production has started. Approved refunds will generally be returned to the original payment method. The customer’s financial institution may require additional time to post the refund. 12. Refunds, Reprints, and Replacements If Logan’s Photography makes an error when producing an order, or if a product arrives damaged or materially defective, contact us promptly. We may request: The order number; The student’s name and school; A description of the problem; A photograph of the damaged or incorrect product; and Other information reasonably necessary to investigate the request. Depending on the circumstances, Logan’s Photography may: Correct the order; Reprint the affected product; Replace the product; Provide another reasonable remedy; or Issue an appropriate refund. Retakes, studio appointments, missed Picture Days, absent students, refunds, and replacements may be governed by the terms of the applicable school photography program. Nothing in this section limits any consumer right that cannot legally be waived. 13. Missed Picture Days and Retakes Make-up dates, retakes, studio appointments, refunds, and other options for missed Picture Days may vary by school and photography program. A make-up or retake opportunity is not guaranteed unless it has been communicated by Logan’s Photography or the participating school. When a customer has paid for a student who was absent, the available options may be stated in the applicable school communication or provided by Logan’s Photography’s customer-service team. A studio appointment may require advance scheduling and may be subject to appointment availability. 14. Digital Images When you purchase a digital image, you receive a limited, nonexclusive, nontransferable license to use the image for personal, noncommercial purposes. Personal use may include: Printing copies for yourself and your family; Displaying the image in your home; Sharing it privately with family and friends; and Posting it to a personal social-media account. Unless Logan’s Photography gives written permission, you may not: Sell or license the image; Use the image to advertise a business, organization, service, product, or political campaign; Claim that you created or own the copyright; Remove a watermark from an unpaid proof; Resell the original digital file; Use the image for artificial-intelligence training; Use the image for facial recognition or biometric identification; Place the image in a stock-photography service; or Use it in unlawful, deceptive, defamatory, or harmful material. These materials are protected by copyright, trademark, and other intellectual-property laws. You may not copy, download, screenshot, reproduce, modify, publish, sell, scrape, distribute, or commercially exploit our content without written permission, except as expressly allowed by the personal-use license supplied with a purchased product. Logan’s Photography’s name, logo, and branding may not be used in a manner that falsely suggests sponsorship, endorsement, partnership, or affiliation. 16. The following may vary by appointment or service: Session length; Session fee or deposit; Clothing requirements; Included poses and backgrounds; Number of people photographed; Late-arrival policy; Cancellation policy; Rescheduling options; and Products included with the session. Additional terms displayed during scheduling or included in an appointment confirmation are incorporated into these Terms. Arriving late may reduce the amount of available photography time or require the appointment to be rescheduled. A missed appointment, late cancellation, or repeated rescheduling may result in the loss of a disclosed session fee or deposit where permitted by law. An appointment does not guarantee a particular expression, pose, background, number of photographs, or finished result unless expressly agreed in writing. 17. Optional Photography and Marketing Permission Purchasing photographs does not automatically authorize Logan’s Photography to use an identifiable student’s portrait for unrelated advertising or promotional purposes. When appropriate, we may request separate permission from: A parent or legal guardian; A student who is at least 18; An authorized school representative; or Another person legally authorized to grant permission. An optional photography or marketing release may authorize selected portraits to appear in: Our website; Social-media pages; Printed marketing materials; Displays; Portfolios; Advertisements; or Other promotional materials described in the release. Marketing permission is voluntary unless a separate agreement expressly states otherwise. Declining an optional marketing release will not prevent a customer from purchasing ordinary photography products. Any authorized use will be governed by the applicable written release or school authorization. 18. Text-Message Program Parents, legal guardians, and high school seniors who are at least 18 may opt in to receive occasional text messages from Logan’s Photography. Messages may include: Picture Day reminders; Appointment confirmations and reminders; Ordering deadlines; Gallery notifications; Order and delivery updates; Customer-service messages; and Promotional messages when the recipient has expressly opted in. For assistance, reply HELP, call 972-224-5172, or email privacy@logansphotography.com. Do not enroll another person’s telephone number without that person’s permission. We do not control the independent privacy, security, availability, or business practices of third-party services. Your use of a third-party service may be governed by that provider’s own terms and privacy policy. Website Availability We work to keep our website available, but we cannot guarantee uninterrupted, secure, or error-free access. The website may be temporarily unavailable because of: Maintenance; Updates; Hosting problems; Internet interruptions; Security concerns; Third-party service failures; or Events outside our reasonable control. Changes to These Terms We may update these Terms to reflect changes in our services, technology, business practices, or legal requirements. When changes are made, we will update the “Last Updated” date at the top of this page. The Terms in effect when you submit an order will generally govern that order unless a change is required by law or you agree to different terms. Your continued use of our website after updated Terms become effective constitutes acceptance of the revised Terms. 27. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
